(As of: May 11, 2022)
OUR CONCERN IS THE PROTECTION OF YOUR DATA
We appreciate your interest in our company, our products and services, and we would like you to feel secure when visiting our website, including with regard to the protection of your personal data. Protecting your privacy is important to us, and compliance with the provisions of the General Data Protection Regulation, the German Federal Data Protection Act (BDSG-new) and the German Telemedia Act (TMG) is a matter of course for us. With this privacy notice, we would like to inform you about when we collect which data and how we use it. As part of our continuous improvement process, we are constantly striving to implement all technical and organizational measures that ensure that data protection regulations are complied with both by us and by the external service providers commissioned by us.
NAME AND ADDRESS OF THE CONTROLLER
The responsible body within the meaning of data protection laws is:
Arevipharma GmbH
Meißner Straße 35
01445 Radebeul
SCOPE OF THE PROCESSING OF PERSONAL DATA
As a matter of principle, we process our users’ personal data only to the extent necessary to provide a functional website and our content and services. The processing of our users’ personal data is generally carried out only with the user’s consent. An exception applies in cases where obtaining prior consent is not possible for factual reasons and the processing of the data is permitted by statutory provisions.
LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA
Insofar as we obtain the consent of the data subject for processing operations involving personal data, Art. 6(1)(a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis. Consent that has been granted may be revoked at any time. This also applies to the revocation of declarations of consent that were granted to us before the GDPR came into effect, i.e. before May 25, 2018. The revocation of consent only takes effect for the future and does not affect the lawfulness of the data processed up to the time of revocation.
Where the processing of personal data is necessary for the performance of a contract to which the data subject is a party, Art. 6(1)(b) GDPR serves as the legal basis. This also applies to processing operations necessary to carry out pre-contractual measures.
Where processing of personal data is necessary for compliance with a legal obligation (statutory requirements) to which our company is subject, Art. 6(1)(c) GDPR serves as the legal basis.
In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6(1)(d) GDPR serves as the legal basis.
If processing is necessary to safeguard a legitimate interest of our company or a third party and the interests, fundamental rights and freedoms of the data subject do not override the former interest, Art. 6(1)(f) GDPR serves as the legal basis for the processing. Examples of such a balancing of interests include advertising or market and opinion research, provided you have not objected to the use of your data, the assertion of legal claims and defense in legal disputes, or the prevention and investigation of criminal offenses.
DATA DELETION AND STORAGE PERIOD
The personal data of the data subject will be deleted or blocked as soon as the purpose of storage no longer applies. Storage may also take place if this is provided for by the European or national legislator in Union regulations, laws or other provisions to which the controller is subject. Data will also be blocked or deleted when a storage period prescribed by the aforementioned standards expires, unless there is a need to continue storing the data for the conclusion or performance of a contract.
RIGHTS OF DATA SUBJECTS
You have the right:
- pursuant to Art. 15 GDPR, to request information about your personal data processed by us. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, as well as the existence of automated decision-making including profiling and, where applicable, meaningful information about the details thereof;
- pursuant to Art. 16 GDPR, to request without undue delay the rectification of inaccurate personal data stored by us or the completion of your personal data;
- pursuant to Art. 17 GDPR, to request the erasure of your personal data stored by us, unless processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defense of legal claims;
- pursuant to Art. 18 GDPR, to request the restriction of processing of your personal data, insofar as the accuracy of the data is contested by you, the processing is unlawful but you oppose the erasure of the data and we no longer need the data, but you require it for the establishment, exercise or defense of legal claims, or you have objected to processing pursuant to Art. 21 GDPR;
- pursuant to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured format or to request that it be transmitted to another controller;
- pursuant to Art. 7(3) GDPR, to revoke your consent once given to us at any time. This has the consequence that we may no longer continue the data processing based on this consent in the future, and
- pursuant to Art. 77 GDPR, to lodge a complaint with a supervisory authority. As a rule, you may contact the supervisory authority of your usual place of residence, workplace, or the place of the alleged infringement.
